Supreme Court upholds ruling for dismissed concrete mixer drivers

The Supreme Court of Cyprus has unanimously rejected an appeal filed by a construction company regarding the 2011 dismissal of four concrete mixer drivers. The employees were terminated under the justification of redundancy, which the plaintiffs challenged as factually incorrect. The court found that the company failed to provide sufficient evidence of genuine redundancy, noting that the employer had hired new staff for similar duties shortly before the layoffs. The judiciary emphasized that the burden of proof rests entirely on the employer and requires more than vague claims of economic decline. The court validated the original ruling which found the dismissals to be unjustified. Consequently, the individual compensation packages awarded to each driver according to the first schedule of labor laws remain in full effect. The appeal process is now finalized, confirming the definitive resolution of the dispute.
