Supreme Constitutional Court dismisses appeal of Cyprus Cow Farmers Organization
On April 6, 2026, the Supreme Constitutional Court of Cyprus rejected the appeal (No. 135/21) filed by the Cyprus Cow Farmers Organization (POA). The court upheld a previous ruling that imposed a total administrative fine of €2,100,000 for violations of the Competition Protection Law. The fine is divided into several categories: €600,000 for price-fixing practices in contracts with farmers, €600,000 for exclusivity and non-compete clauses, €100,000 regarding 'Smooth Milk Production' practices, and €800,000 for imposing unfair prices as a dominant enterprise. In its appeal, the POA argued that the Commission for the Protection of Competition lacked impartiality, questioned the dual role of the Commission as investigator and judge, and contested procedural issues regarding data access. The Supreme Constitutional Court dismissed these claims, ruling that the legal grounds were unfounded and that the initial court had assessed the case correctly. The final judgment confirms the legality of the Commission's procedures and findings.
