Recent court rulings regarding Competition Protection Commission fines
The Administrative Court dismissed an appeal by the Cyprus Telecommunications Authority (CYTA), upholding a 2018 decision by the Commission for the Protection of Competition (CPC). The ruling confirms a fine of €1,166,175 imposed on CYTA for abusing its dominant position in the retail fixed telephony, broadband, and subscription television markets between 2009 and 2010. Separately, the Supreme Constitutional Court rejected an appeal by the Pancyprian Milk Producers Organization (POA) on April 6, 2026. This decision upholds a total administrative fine of €2,100,000 against the POA. The breakdown includes €600,000 for price-fixing, €600,000 for exclusivity clauses, €100,000 for milk production practices, and €800,000 for charging unfair prices. The POA had challenged the impartiality of the CPC chair and the commission's dual role, but the court ruled these arguments meritless. Both judicial outcomes affirm the legality of the CPC's investigation procedures and factual findings.
