Florida woman awarded 14 million dollars after consuming metal shards in ice cream
On September 11, 2018, Brandi Buckley purchased a butter pecan ice cream cone from a Bruster's Ice Cream drive-through in Palm Bay, Florida. Shortly after consuming the product, she realized she had ingested metallic nails and fragments that were embedded within the ice cream and not visible to the naked eye. Medical examinations, including X-rays, confirmed the presence of a nail in her throat. In a 2019 lawsuit against entities associated with the Bruster's brand, Buckley alleged that she suffered severe, permanent physical and neurological injuries, including damage to her head, neck, and limbs. She also reported significant scarring, disfigurement, and a loss of bodily function. The plaintiff and her husband stated that these injuries prevented them from having more children. Furthermore, the lawsuit cited extensive medical expenses, lost income, and diminished future earning potential. The legal action accused the company of failing to ensure the safety of their food products, ultimately resulting in a 14 million dollar compensation award for the victim.
